USCG Law is that ALL children under 13 MUST be wearing a proper USCG-Approved, proper size life Jacket at all times when on deck. Many states have their own laws and if so the State Law prevails (on State Waters, on Federal waters the USCG ruling prevails). Most State Laws allow the kids to remove the PFD if below decks. I think more because it is safer than because the kids had any issue with the life jackets. You might get a harness and give him the choice of the harness or the life jacket. My comment about boat size is that if there is a chance of capsize, perhaps the harness isn't what you want.
