Am I reading this right and this was a decision rendered in 2008?? Is
"Tex. App" short for Texas Appeals court I wonder?

Yes, and yes. I am not an admiralty lawyer, but I thought that most
such cases were in federal court. Maybe the plaintiffs wish that they
had been.

LOL being from Texas it is pretty much of a "take care of your own self"
kinda place so that doesn't surprise me.

The good aspect of this rule is it is still legal to use a press gang to fill out the complement of crew for your next race.
